What can I build in C4 Environmental Living?
C4 Environmental Living is for houses in places the council wants to protect: bushland, escarpments, foreshores and scenic ridgelines. Until the environment zones were renamed conservation zones it was called E4 Environmental Living, and older documents still use that name.
It works differently from the residential zones. Anything the council hasn't listed as permitted is prohibited, the state's complying development codes for houses don't generally cover it, and the development application is judged against the land's environmental values. What is C4 Environmental Living zoning?
It is a zone for low impact housing in areas with special ecological, scientific or aesthetic values. Those are its two objectives in the Standard Instrument: to provide for low impact residential development in those areas, and to make sure residential development doesn't have an adverse effect on those values. Every development application in C4 is weighed against them.
What can I build in C4 Environmental Living?
A house, with development consent, and only what else your council has listed. The Standard Instrument requires every C4 zone to permit dwelling houses with consent and home occupations without consent. It also makes C4 a closed zone: anything not listed as permitted is prohibited, and industries, service stations, warehouses and distribution centres are always prohibited.
That is the opposite of how many councils write their residential zones, where uses are often permitted unless they are listed as prohibited. In C4, if a use isn't in the permitted lists, you can't do it. Can I build a granny flat in C4?
Only if your council's LEP lists secondary dwellings as permitted in C4. The Housing SEPP's granny flat rule covers the R1 to R5 residential zones, not C4, so it doesn't make a granny flat permissible here, and in a closed zone an unlisted use is prohibited.
Can I build a duplex or dual occupancy in C4?
Only if your council's LEP lists dual occupancies in C4, and many don't, given the zone's aim of low impact housing. The 2024 statewide duplex rule applies to R2 only, and the low and mid rise reforms don't apply to C4.
Can I use complying development in C4?
Generally not for a new house. The Codes SEPP's Housing Code covers R1, R2, R3, R4 and RU5, and the Rural Housing Code covers R5 and the rural zones, so neither covers a new house in C4 except where the Codes SEPP makes a specific exception for a council. Expect a development application. Smaller works such as a garden shed or a deck may still be exempt development if they meet the state's exempt development standards. See complying development.
What will council look at in a C4 development application?
Mainly whether the house protects the values the land was zoned for. That usually means how much vegetation is cleared and which trees are removed, the visual impact from roads, water or ridgelines, the building's height and bulk, stormwater and erosion, and the effect on threatened species or habitat. Is C4 the same as the old E4 zone?
Yes. The environment protection zones E1 to E4 were renamed conservation zones C1 to C4 when the employment zones came in, and the land use tables did not change. The code E4 now belongs to a different zone, General Industrial, so a document that says E4 needs reading carefully: E4 Environmental Living is today's C4.
Can I subdivide a C4 block?
Only if each new lot meets the minimum lot size your LEP maps for the block, and C4 minimums are often large to keep development low impact. The council will also weigh the subdivision against the zone's environmental objectives. Minimum lot size explains how to read the map.
Can I run a business from home in C4?
Home occupations are permitted without consent in every C4 zone, as long as only the people who live there work in it and no goods are displayed or sold by retail. Home industries are permitted only if your council chose to list them, and anything larger is likely prohibited in a closed zone.
What else do people ask?
Is C4 land national park?
No. C4 is private land where houses are permitted. National parks and nature reserves are zoned C1, and C2 Environmental Conservation and C3 Environmental Management carry stricter objectives than C4.
Is it harder to get a house approved in C4?
Usually, yes. The list of permitted uses is closed, a new house usually needs a development application rather than complying development, and the application is weighed against the land's environmental values, often with bushfire and slope reports on top. Allow more time and more consultant reports than for a house in R2.
Can I clear trees on my C4 block?
Usually only with approval. Clearing native vegetation is controlled by state biodiversity law and the council's tree rules, and in C4 the zone objectives add weight to keeping it. Ask the council before removing trees, even for a house site or bushfire protection.
